YOU RECOGNIZE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, IN NO EVENT NEWS CREOLE OR ITS SUBSIDIARIES, INCLUDING, WITHOUT LIMITATION, OFFICES, DIRECTORS, EMPLOYEES, SUCCESSORS AND ASSIGNED, BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY LOSS, DAMAGE, COSTS, EXPENSES OR LIABILITY OR IMPLIED WHATSOEVER ( “LOST”) ARISING IN ANY WAY AVAILABILITY, USE, RELIANCE OR INABILITY TO USE THE NEWS CREOLE SITE, AS WELL AS (WITHOUT LIMITATION): (i) DAMAGES FOR BUSINESS INTERRUPTION, LOSS BUSINESS AND OTHER PROFITS, LOSS OF PROGRAMS, COST OF REPLACING EQUIPMENT OR SOFTWARE OR LOSS OF LOSS OF USE OF DATA, LOSS OF REVENUE, LOSS OF WELFARE, LOSS OF BUSINESS, LOSS OR DAMAGE TO REPUTATION, LOSS OF CAPITAL, DELAY EXPENSES, LOSS UNDER ANOTHER CONTRACT OR IN CONNECTION WITH ANOTHER CONTRACT FOR SAVINGS OR PROVIDED BENEFITS; (Ii) ANY INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, MINOR OR SIGNIFICANT LOSS; OR (iii) ANY LOSS ATTRIBUTABLE TO ERRORS, OMISSIONS OR OTHER INACCURACIES IN THE NEWS CREOLE SITE.
IN SUCH STATES OR JURISDICTIONS, THE LIABILITY OF THE NEWS CREOLE IS LIMITED TO EXTEND ALLOWED BY LAW (IS MINIMIZING THE LIABILITY OF NEWS CREOLE REGARDING THE LOWER AMOUNT THAT APPLICABLE LAW PERMITS)
